Welcome to Eloise Molly. These Terms of Service apply when you visit our website, create an account or purchase products from us. By using our website or placing an order, you agree to these terms.

In these terms, “Eloise Molly”, “we”, “us” and “our” refer to Eloise Molly (41 580 010). “You” and “your” refer to anyone who accesses our website or purchases from us.

1. Our Online Store

Our website is provided for personal, non-commercial use. You must not use our website or products for any unlawful purpose or interfere with the security, operation or accessibility of the website.

You are responsible for ensuring that the information you provide when placing an order is complete and accurate, including your name, email address, delivery address and payment details.

2. Products

We take great care to present our pieces as accurately as possible. However, colours may appear slightly different depending on your screen, lighting and device settings.

Product descriptions, measurements and sizing information are provided as a guide. We recommend reviewing the relevant size guide before placing your order.

All products are subject to availability. We may limit the quantity of an item available for purchase or discontinue a product at any time.

3. Orders

Placing an order does not guarantee that it has been accepted. Your order is accepted once payment has been approved and you receive an order confirmation from us.

We may cancel or decline an order where:

  • an item is unavailable;

  • payment cannot be processed;

  • the delivery or billing information appears incorrect;

  • we reasonably suspect fraud or unauthorised activity; or

  • there has been an obvious pricing or product-description error.

Should we cancel an order after payment has been received, we will refund the amount paid to the original payment method.

4. Pricing and Payment

All prices are displayed in Australian dollars unless otherwise stated. Prices include GST where applicable.

Shipping charges and any other applicable costs will be displayed at checkout before payment is completed.

We may update our prices at any time. Any change will not affect an order that has already been accepted, unless an obvious pricing error has occurred.

You confirm that you are authorised to use the payment method selected at checkout.

5. Promotions and Discount Codes

Promotional offers and discount codes are subject to the conditions stated at the time of the promotion.

Unless otherwise stated:

  • only one discount code may be used per order;

  • discount codes cannot be applied after an order has been placed;

  • offers cannot be exchanged for cash; and

  • promotions may be changed, suspended or withdrawn where reasonably necessary.

6. Shipping and Delivery

Orders will be delivered to the address provided at checkout. Please check your delivery details carefully, as we may be unable to change an address after an order has been dispatched.

Delivery timeframes are estimates and may be affected by circumstances outside our reasonable control, including postal delays, severe weather and peak trading periods. We will provide updates when we become aware of a significant delay.

Eloise Molly is not responsible for delays caused by incorrect or incomplete delivery information supplied by the customer.

7. Returns

We accept eligible change-of-mind returns within 30 days of delivery.

Returned items must be unworn, unwashed and in their original condition, with all original tags attached. Items showing signs of wear, makeup, fake tan, perfume, deodorant, washing, alteration or damage may not be accepted.

Customers are responsible for arranging and paying for change-of-mind return shipping. We recommend using a tracked service, as we cannot accept responsibility for returns lost or damaged in transit.

Original delivery charges are non-refundable for change-of-mind returns. Approved refunds will be issued to the original payment method after the returned item has been received and inspected.

8. Faulty, Damaged or Incorrect Items

Please contact us promptly if you receive an item that is faulty, damaged or different from what you ordered. Include your order number and clear photographs of the issue so we can assist you.

Our voluntary returns policy does not limit any rights or remedies available to you under the Australian Consumer Law. Consumer guarantees cannot be excluded by store policies, and customers may be entitled to a repair, replacement or refund when goods fail to meet those guarantees. Where an item is confirmed to have a problem, reasonable return costs already paid by the customer must generally be reimbursed. (ACCC)

9. Cancellations and Order Changes

Please contact us as soon as possible should you need to change or cancel an order.

Once an order has entered processing or has been dispatched, we may be unable to cancel or amend it. In this situation, you may return the item after delivery in accordance with our Returns Policy.

10. Intellectual Property

All content appearing on the Eloise Molly website—including our brand name, logos, product names, photographs, designs, graphics, videos and written content—is owned by or licensed to Eloise Molly and is protected by applicable intellectual-property laws.

You may view and use our website for personal shopping purposes. You must not reproduce, distribute, modify, sell or commercially use our content without our prior written permission.

11. Customer Reviews and Submitted Content

When you submit a review, photograph, comment or other content to us, you confirm that:

  • the content is truthful and based on your genuine experience;

  • you have the right to share it;

  • it does not infringe another person’s rights; and

  • it is not unlawful, offensive, misleading or harmful.

You give us permission to display and reproduce submitted content for our website, social media and promotional materials. We will seek any additional permission required before using content in a way that identifies you beyond the information you have chosen to publish.

We handle personal information in accordance with our Privacy Policy and applicable privacy laws.

When you place an order, we may share information with service providers where reasonably necessary to process payments, fulfil orders, deliver purchases, operate our website and provide customer support.

To the extent permitted by law, Eloise Molly is not responsible for indirect or consequential loss arising from the use of our website or products where that loss was not reasonably foreseeable.

Should any part of these terms be found unlawful or unenforceable, that part will be removed or limited to the minimum extent necessary. The remaining terms will continue to apply.

18. Governing Law

These terms are governed by the laws of Queensland, Australia, together with applicable Commonwealth laws.

Any dispute will be subject to the jurisdiction of the courts and tribunals of Queensland and Australia, subject to any rights you have to bring a claim in another jurisdiction under applicable consumer law.
